Stake.us Legal States
Stake.us legal states are simple to state and easy to get wrong: Stake.us is open to adults 21 and older in the continental United States and Hawaii, except 22 excluded states, and Alaska is not in the eligible area. It is available where it is because it runs as a social casino with a sweepstakes layer and a No Purchase Necessary route, not as a licensed casino. The list changes with Terms updates, so the Terms are the authority, and this page shows the version 18 list for 2026.

Can You Play Stake.us in Your State?
Most questions about Stake.us come down to one: can I play where I live? The answer is a state list and an age rule, both set by the operator in its Terms. This page gives you the list, the reasoning behind it, short answers for the states people ask about most and a way to check your own state before you play.
Stake.us Legal States: Where You Can Play
Stake.us serves players in the continental United States and Hawaii, except in 22 excluded states. Alaska is not in the eligible area. The state table above shows every state with a status: eligible, excluded, or eligible with a limit. Florida carries the limit, because the Terms cap Florida redemptions at $5,000 per day.

The eligible states under the current Terms are Alabama, Arkansas, Colorado, Florida, Georgia, Hawaii, Iowa, Kansas, Massachusetts, Minnesota, Mississippi, Missouri, Nebraska, New Hampshire, New Mexico, North Carolina, North Dakota, Ohio, Oklahoma, Oregon, South Carolina, South Dakota, Texas, Utah, Virginia, Wisconsin and Wyoming. Being in the list is necessary but not enough. You must also be 21 or older, pass the identity check and be physically in an eligible state when you play.
How to read the table: each state is marked eligible, excluded or limited, and limited means eligible with a rule you should know. The source is clause 2.1 of the Stake.us Terms, version 18, and the help center’s restricted states article, which agree on the same 22. If you see another page that lists fewer states, it is out of date.
Stake.us Restricted States
The 22 excluded states are, in groups:
- East: Connecticut, Delaware, Maine, Maryland, New Jersey, New York, Pennsylvania, Rhode Island, Vermont and West Virginia.
- South: Kentucky, Louisiana and Tennessee.
- Midwest: Illinois, Indiana and Michigan.
- West: Arizona, California, Idaho, Montana, Nevada and Washington.
The help center explains the logic: the site operates within the legal frameworks of states that permit social casino platforms, and it needs to keep the platform out of states where its services are not legally permitted. The Terms have been revised 18 times since 2022, and most revisions added states to the excluded territories. Since 2025 alone, ten revisions in a row have each added at least one state. The Terms also reserve the right to exclude any other jurisdiction from time to time, at the operator’s discretion. That pattern matters most: the list has grown, it can grow again, and a state that is open today can close after the next update.
What does an exclusion mean for you? If you live in an excluded state, you cannot use Stake.us, and the Terms tell residents of those states not to proceed with registration at all. The same goes for anyone outside the continental United States and Hawaii, because every other country is an excluded territory too. Do not try to work around it. Using a service that masks your location breaches the Terms, which warn that it can amount to fraud. The right move is to leave Stake.us alone and, if you want social casino entertainment, look at what your own state allows.
If you are an eligible player who moves to an excluded state, the same rule applies, because the Terms are tied to where you live and where you play. Check the list again for your new state before you play there.
Is Stake.us Legal in California, Texas, Florida, New York and Ohio?
These five states account for most of the search traffic on Stake.us eligibility, and Illinois draws its own. The answers come straight from the state table.
Is Stake.us Legal in California?
No. California is an excluded state. Stake.us is not available to players in California, and the exclusion is written into the Terms. If you live in California, the account cannot be opened or used.
Is Stake.us Legal in Texas?
Texas is an eligible state. Texans who are 21 or older can register, verify and play, and prize redemptions follow the standard rules with no state-specific cap. The usual identity and 2FA steps apply.
Is Stake.us Legal in Florida?
Florida is eligible under the Terms, with one extra rule: the maximum redemption value is $5,000 per day. Anything above that amount in a day is not allocated or paid. Plan large redemptions with that in mind, and read the Stake Cash and Gold Coins guide for the full redemption steps. Sweepstakes rules are changing in several states, Florida included, so recheck the Terms before you rely on the table.
Is Stake.us Legal in New York?
No. New York is an excluded state, and Stake.us is not available to players there.
Is Stake.us Legal in Ohio?
Ohio is eligible under the current Terms, version 18. As with every state on the eligible list, a future update can change that, and the Terms are the place to confirm it.
Is Stake.us Legal in Illinois?
No. Illinois is an excluded state. Players in Illinois cannot use Stake.us.
Other states come up often as well. Arizona, Michigan, Nevada, New Jersey, Pennsylvania and Washington are excluded. Colorado, Georgia, Massachusetts, Missouri, North Carolina, Oklahoma and Virginia are eligible. The table above covers all 50 states if yours is not named here.
If you searched “is Stake legal in the US” because you meant the offshore Stake site, the answer depends on which Stake you mean. Stake.com is not offered to US residents under its own Terms. Stake.us is the US product. The Stake.com vs Stake.us page explains the difference in one table.
What the Stake.us Terms Say About Your Location
Two clauses in the Terms decide the location question. The first lists the excluded territories: anywhere outside the continental United States and Hawaii, the 22 named states, and any other state or jurisdiction that is legally precluded or that Stake.us excludes at its discretion from time to time. The second is the warranty you give when you register: you declare that you do not reside in, or access the platform from, an excluded territory. Both parts count. Where you live and where you are when you play must each be eligible.
The Terms treat a false statement about this seriously. Registering from an excluded state is described as a material misrepresentation, and Stake.us reserves all rights to act. Using a service that masks or manipulates your location, or giving false details about where you live, breaches the Terms, and the Terms say it can be fraud. The Terms also put the burden on the player: it is your responsibility to make sure that taking part is lawful where you are, and you agree to use Stake.us for recreation and entertainment only, on your own behalf.
None of that is unusual for a sweepstakes operator, and none of it is hard to follow. Check the state table, check the Terms, use your real address and play only from an eligible state.
Stake.us Age Requirement
The minimum age on Stake.us is 21. Where your state sets a higher legal age, that higher age applies. There is no 18+ route, and any page that says otherwise is wrong. The Terms state the rule, the help center repeats it, and the identity check enforces it. You also confirm in the Terms that the details you give are true and complete, and that you will tell Stake.us if they change.
Age is checked with the same tool as identity. Veriff asks for a live photo of an ID card or driver’s license and a live selfie, and the date of birth on the document must show that you are old enough. Verification is required before any prize redemption, so age and identity are never skipped. The Stake.us login page explains the check step by step. This site is for adults, and nothing on it is meant for anyone under 21.
Why Stake.us Is a Sweepstakes Casino
Stake.us is built as a social casino, and the sweepstakes layer is what lets it operate where a licensed casino could not. There are four parts.
- There is no cash-stakes play: nothing you play with is money. Gold Coins are for entertainment, and Stake Cash is a promotional token.
- No Purchase Necessary applies: Stake Cash can always be collected free through the daily bonus, giveaways and the mail-in request, so nobody has to pay to take part.
- Gold Coins have no value: they cannot be redeemed, exchanged or converted to Stake Cash.
- Stake Cash is promotional: it can be redeemed for prizes at an implied rate of 1 SC = 1 USD, after identity verification and any playthrough.
The Terms add a plain rule on top: a purchase of any kind will not increase your chances of winning a prize. Buying a Gold Coin package gives you coins to play with and, in most cases, bonus Stake Cash, but it does not tilt the sweepstakes.
Sweepstakes are void where prohibited by law, which is why the excluded-state list exists. The operator is Sweepsteaks Limited, registered in Cyprus under number HE436222. Stake.us holds no gaming license, and it does not claim one. The reason is structural: a gaming license regulates cash-stakes play, and Stake.us says it does not offer that. The controls that carry the weight are the Terms, the 21+ rule, the state list, Veriff identity checks and 2FA. That is also the honest answer to “is Stake.us legit”: it is a documented, identifiable operator running a sweepstakes model under published rules, and the main risk for you is eligibility, not trust in a license.
How to Check Your State Before You Play
Do this before you register, and again if you move or hear that the rules changed:
- Find your state in the table above and note its status.
- Open the Terms on Stake.us and check clause 2.1 for the current excluded list.
- Confirm you are 21 or older, or older if your state sets a higher age.
- Remember that your physical location counts when you play, and that using a service that masks it breaches the Terms.
- If you are unsure, ask live chat before you register. Support can answer eligibility questions, and the answer is better than a guess.
If your state is eligible, the next steps are the Stake.us login guide and, for a closer look at the operator, the Stake.us review. If your state is excluded, do not register.
Even in an eligible state, play should stay entertainment. The Responsible Social Gameplay page explains the break in play and self-exclusion tools. For help from a national resource, the NCPG helpline is 1-800-MY-RESET (1-800-697-3738), by call, text or chat.
